Preamble

Any order placed on the websites www.boutique-culturespaces.com/atelierdeslumieres, www.boutique-culturespaces.com/bassinsdelumieres, www.boutique-culturespaces.com/carrieresdelumieres, www.boutique-culturespaces.com/hoteldecaumont, www.boutique-culturespaces.com/chateaudesbauxdeprovence, www.boutique-culturespaces.com/villaephrussirothschild, www.boutique-culturespaces.com/museejacquemartandre,  (hereinafter referred to as "the Site") of SA Culturespaces (hereinafter referred to as "the Seller") will be exclusively governed by these general terms and conditions of sale, which we recommend that you read carefully. The fact of placing an order implies prior consultation of these general terms and conditions of sale and constitutes full and irrevocable acceptance thereof. The Site, the source code, texts, images and other elements of the Site are the exclusive property of the Vendor. The entire content of the Site is protected by copyright legislation. As such, and in accordance with the provisions of the intellectual property code, only the use of the Site for private use is authorized. Otherwise, the offender may be prosecuted before the competent court.

Article 1 : Acceptance of these general conditions of sale

These General Terms and Conditions of Sale (hereinafter "Terms and Conditions") are intended to define the rights and obligations of the parties in the context of distance selling of products offered by the Seller on the Site. The Customer acknowledges having read these Terms and Conditions when validating the order. Any validation of its order is worth acceptance of the General Terms and Conditions without exception. The Vendor reserves the right to adapt or modify these Terms and Conditions at any time. In case of modification, the General Terms and Conditions in force on the day the order is placed will be applied to each order.

Article 3 : Offer and availability of products

Product offers are valid as long as they are visible on the Site. The products are offered for sale in all countries recognized by the international community.

Article 4 :  Product prices and order amount

4.1. Selling price of the products

The selling prices of the products are those displayed on the Site at the time of purchase by the Customer. These sales prices are indicated inclusive of VAT at the rate applicable on the day of the order and do not include the cost of gift wrapping or shipping charges invoiced in addition. Any change in this rate will be automatically reflected in the sale price of the products.

Caution: for a delivery outside the European Union, the Customer must in addition pay the customs duties and other taxes due for the importation of products into the territory of delivery.

4.2. Total amount of the order

The total amount of the order is the final price in euros, including all taxes, processing and shipping costs. It is included in the order confirmation e-mail and in the electronic invoice that can be downloaded once payment has been made or from the account created by the Customer.

Article 5 : Placing the order

The Customer places an order for one or more products offered for sale on the Site. The procedure for placing an order online includes the following steps: Cart / Identification / Address / Delivery / Validation / Payment. In case of refusal of payment by the bank concerned, the order is automatically cancelled. Any order validated by the Customer on the "Validation" page constitutes an irrevocable acceptance which can only be called into question in the case restrictively provided for in Article 7 (exercise of the "Right of withdrawal") of these Terms and Conditions.

Article 6 : Order confirmation 

Once payment has been made, the Customer receives an e-mail confirming his order.  The confirmation e-mail acknowledges receipt of the order. This e-mail constitutes for the Customer a proof of his order that the Seller recommends him to keep.  

Article 7 : Right of retraction

The Customer has a period of 14 working days to return, at his own expense, the products that do not suit him, for whatever reason. In the event of exercising the right of retraction, the Customer will have the choice to ask the Customer Service either for a refund of his order, except for the return costs that he will have incurred, or for an exchange of the product for a product of equivalent quality and price. To do so, he will have to complete the return form to be cut out at the bottom of the delivery note attached to the package, staple his bank or postal identification statement to it if he wishes to be reimbursed and send it with the said product(s) in their original packaging in perfect condition to the following address:

Upon receipt of the said product(s), Customer Service will contact the Customer (by e-mail or telephone) to remedy the notified problem as soon as possible, at the latest within 30 days following the date on which the right of withdrawal was exercised.

In the event of a request for reimbursement, the Seller undertakes to reimburse the Customer for all sums paid, with the exception of the return costs incurred by the Customer. This reimbursement shall be made exclusively by bank transfer.

In accordance with Article L. 120-20-2 of the Consumer Code, the right of withdrawal may not be exercised for audio or video recordings or computer software unsealed by the Customer, as well as for newspapers, periodicals or magazines.  

Article 8 : Secure payment

Online payments are made via the secure payment system VERIFONE. Via this system, the Seller guarantees the security and confidentiality of customer data relating to their means of payment. The Seller has indeed adopted the SSL encryption process, which ensures the reliability of exchanges and transactions by encrypting at the time of their entry all personal data required to process orders, such as postal and e-mail addresses, bank details. The banking coordinates of the customers are not known by the Salesman, only the total amount and the number of order are transmitted to PAYBOX. An invoice will be addressed to the customer for any order carried out on line on the Site.

Article 9 : Method of payment - Payment - Invoice

9.1. Methods of payment

The Customer may choose to pay for his order by credit card or by letter of credit card. The following cards are accepted: CREDIT CARD / VISA / MASTERCARD / AMERICAN EXPRESS. Payment is made exclusively in euros.

9.2. Payment transaction

The Customer warrants to the Seller that it has the authorizations that may be necessary to use the chosen method of payment. If the card used by the payment center is refused, the order is automatically cancelled. The Customer is invited to print the proof of the transaction that will appear on the screen after effective payment of the order.

9.3 Invoice

The electronic invoice can be downloaded by the Customer when he returns to the Site after paying his order. It can be accessed at any time by the Customer when he logs into his Customer Account.  

Article 10 : Order processing - Delivery methods

10.1 Order processing time

Except for public holidays, orders placed from Monday to Thursday are processed and shipped the next day. Orders placed on Fridays, Saturdays and Sundays are processed and shipped the following Monday.

10.2 Proposed methods of delivery

Deliveries in Metropolitan France and Monaco:

Colissimo France with or without signature: delivery within 48 hours working days - delivery within 72 hours working days for an order placed on a weekend or the day before a weekend, a public holiday or the day before a public holiday.

Overseas deliveries: Colissimo Overseas/Outre-Mer formula (delivery within 5 to 7 working days - delivery within 7 to 9 working days for an order placed on a weekend or the day before a weekend, a public holiday or the day before a public holiday).

Deliveries in Europe: Colissimo International formula (delivery within 5 to 10 working days - delivery within 5 to 7 working days for an order placed on a weekend or the day before a weekend, a public holiday or the day before a public holiday).

Culturespaces accepts no responsibility in the event of a strike by the delivery services.

10.3 Tracking and receipt of the order

The Customer is informed of the dispatch of his order by an e-mail containing a delivery tracking link.

The Customer undertakes to receive the products ordered at the delivery address indicated on the order confirmation e-mail.

The Customer must imperatively date and sign the delivery slip presented by the carrier. This dated and signed delivery slip constitutes proof of transport and delivery.

In the event of the Customer's absence, he has a period of time indicated by the carrier to receive his package.

Caution - In case of non withdrawal within the time limit, the products will be returned to the Seller who reserves the right to reimburse the amount of the order, excluding delivery costs which will remain the responsibility of the Customer.

10.4 Exchanges and refunds

The Customer has a period of seven working days to return, at his own expense, the products that do not suit him, for whatever reason. In the event of exercising the right of retraction, the Customer will have the choice to ask the Customer Service either for a refund of his order, except for the return costs that he will have incurred, or for an exchange of the product for a product of equivalent quality and price. Exchanges and refunds are not possible in the store.

Article 11 : Guarantees

The products delivered benefit, in accordance with the legal provisions, from the guarantee of conformity and the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the product and making it unfit for use. Caution:

- any legal warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the Customer, as in the event of normal wear and tear of the product, in the event of an accident, in the event of an act of the Customer, or in the event of force majeure as defined in Article 13 of the General Terms and Conditions ;

- any warranty is limited to the replacement or reimbursement of the product(s) that do not conform or are affected by a non-conformity or a defect;

- in order to assert its rights, the Customer must, on pain of forfeiture of any related action, inform the Seller in writing of the existence of the non-conformity of the product(s) delivered and of the latent defect affecting the product(s) within a short period of time from its discovery.  

- No product will be exchanged or refunded without the Vendor's agreement and before it has been returned (preferably in its packaging) by the Customer to the address shown in Article 2 of the General Terms and Conditions.

Customer Service undertakes to exchange the product(s) concerned, or to reimburse the Customer as soon as possible. The return costs and, where applicable, the shipping costs of the new product shall be borne by the Seller.  

Article 12 : Responsibility

In all cases, the Seller shall not be liable in the event that the non-performance of its obligations is attributable either to the Customer, or to the unforeseeable and insurmountable fact of a third party to the contract, or to a case of force majeure as defined in Article 13 of the General Terms and Conditions. Likewise, the Seller shall not be liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses. The Seller, owner of the Site, undertakes exclusively to comply with the legislative or regulatory provisions in force in France. Hypertext links may refer the Customer to websites other than the Site. The Vendor shall not be held liable in the event that the content of these sites contravenes the legal and regulatory provisions in force. 

Article 13 : Force majeure

Neither the Seller nor the Customer shall be held liable for any non-performance due to a case of force majeure. Without this being restrictive, are considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French courts and tribunals: total or partial strikes internal or external to the company, blocking of means of transport or supply for any reason whatsoever, government or legal restrictions, computer breakdowns, blocking of telecommunications including networks and especially the Internet.  

Article 14 : Evidence - Conservation - Archiving

The computerized registers, kept in the Seller's computer systems, under reasonable conditions of security, shall be considered proof of the contract of sale, its date, orders and payments between the parties. The archiving of orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful copy, in accordance with Article 1348 of the Civil Code.   

Article 15 :  Protection of personal data

- Access right to the file

The nominative information requested from the Customer is necessary for the processing and routing of orders as well as the edition of delivery notes and invoices. The personal data collected are processed by the Seller in compliance with the legal provisions relating to the protection of personal data under Law No. 78-17 of January 6, 1978, known as "Informatique et Liberté":

* the Customer is informed that this authorized processing of information has been declared to the CNIL.  

* the Customer has at any time the right to access, modify, rectify and delete personal data concerning him/her. He may exercise this right with the Seller by sending a letter in which he will attach proof of his identity (photocopy of an identity document) to the following address: boutiques-sav@boutique-culturespaces.com

The Client concerned may consent, at the time of collection of his/her personal information, to the communication of this data to third parties, as well as to receive by e-mail newsletters about exhibitions, events and promotional offers within the Culturespaces boutique. To do so, simply tick the relevant boxes. Thereafter, in accordance with the regulations in force, he or she may at any time unsubscribe from the newsletter list and the list of third parties by sending an e-mail to the following address: boutiques-sav@boutique-culturespaces.com.

The Customer may also receive proposals from partner companies at his postal address. If he does not wish to do so, all he has to do is specify this to the Vendor either by post or by e-mail, indicating his surname, first name, postal address, and possibly his customer number.

Article 16 : Cookies

To facilitate your navigation on the Site, the Vendor uses cookies. Cookies are files stored on the hard disk of the Customer's computer that are used to report the Customer's visit to the Site, when consulting other pages of the Site or during a new visit, and to record information relating to navigation (pages consulted, date and time of consultation ...). The information thus collected by the Seller being subject to computerized processing, you have a right of access, rectification and deletion under the conditions set out in Article 15.  

Article 17 : Entire general conditions

The Parties acknowledge that these general terms and conditions of sale constitute the entire agreement between them. If, for any reason whatsoever, one of the clauses of these general terms and conditions were to be declared inapplicable, it would be deemed unwritten without invalidating these general terms and conditions or altering the other provisions of the general terms and conditions.  

Article 18 : Settlement of litigations

The present General Terms and Conditions, as well as any order placed by the Customer are governed by French law.

Any claim must be made in an appropriate manner and allow us to keep proof of the litigious fact, specifying the details of your dissatisfaction as well as your order number. If you do not receive a satisfactory response within 60 days following the sending of your complaint, you have the possibility of referring the matter to the Tourism and Travel Mediator, whose contact details and methods of referral are available on the website http://www.mtv.travel.
